Terms of Service

Welcome to iRide ("Company," "we," "us," or "our"). By accessing or using our website at iridesfo.com and our mobile booking platform (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Nature of Services / Relationship of Parties

1.1 Scope of Service: iRide (the "Company") provides a web and mobile-based platform that connects users ("Riders") with independent professional transportation providers ("Carriers"). The Company is a booking agent as defined under California Public Utilities Code § 5360.1.

1.2 No Carrier Relationship: The Company does not own, operate, or maintain vehicles and does not employ drivers. All transportation services are provided by independent Carriers who maintain their own valid California Public Utilities Commission (CPUC) Charter-Party Carrier (TCP) authority, commercial insurance, and enrollment in mandatory DMV Employer Pull Notice (EPN) and drug testing programs.

1.3 Independent Contracting: The Rider acknowledges that the decision to book a ride is based on the Carrier's credentials. The Carrier is solely responsible for the safety, execution, and quality of the transport. The Rider will pay the Carrier directly for the transportation services, and the Company's fee is strictly for the use of the booking technology.

1.4 Regulatory Compliance: All rides booked through iRide are pre-arranged via electronic communication. Carriers are required by law to generate and possess a digital waybill for every trip, which iRide facilitates as a technology provider.

2. Service Description

iRide is a premium black car transportation platform connecting riders with licensed, independent contractor drivers in the San Francisco Bay Area. We facilitate bookings for point-to-point rides and hourly charters.

3. Eligibility

You must be at least 18 years old to create an account and use the Service. By registering, you represent that all information you provide is accurate and complete.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

9. Payments

Rider payments are processed securely via Stripe. Drivers receive their earnings minus iRide's commission after ride completion. iRide does not store credit card information on its servers.

10. Limitation of Liability

To the maximum extent permitted by law, iRide shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. iRide's total liability shall not exceed the amount you paid to iRide in the 12 months preceding the claim. iRide is a technology platform and is not responsible for the actions of independent contractor drivers.

11. Indemnification

You agree to indemnify and hold harmless iRide, its officers, directors, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Intellectual Property

All content, trademarks, logos, and software associated with iRide are the property of iRide. You may not copy, modify, or distribute any part of the Service without written permission.

13. Modifications

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.

14. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of San Mateo County, California.
